Google, Oracle to Hold Last-minute Settlement Talks

Oracle and Google will hold another round of settlement talks as the trial date nears in their high-stakes court battle over Google's alleged misuse of Java in Android.

A magistrate judge assigned to the case has ordered senior executives from both sides to be present at the talks. The participants must include "at least" Oracle President Safra Catz and Andy Rubin, the head of Google's Android division, according to an order issued Friday.

The talks must take place no later than April 9, the magistrate judge wrote. An eight-week jury trial is scheduled to begin on April 16.

Both parties may feel they have some incentive to settle. Oracle has struggled to show the court how it arrived at its damages estimate, and the amount it now seeks at trial appears significantly lower than it had originally hoped for. And Google has tried and failed repeatedly to have a potentially damaging email written by one of its engineers excluded from the case.

Still, it's not clear what prompted the judge to order the new round of talks at this time. The parties have met several times before, including in a face-to-face meeting between Oracle CEO Larry Ellison and Google CEO Larry Page, and failed to find common ground.

However, the likelihood of a settlement often increases as a trial date draws closer.

Oracle accuses Google of using Oracle's Java technology in Android in a way that violates its patents and copyrights. Google denies any wrongdoing.

Top 5 Health Issues Facing American Pets Today | Seattle Dog Spot

Earlier this week, WebMD posted an article by?Ann Hohenhaus, DVM listing the top 5 health issues facing American pets today. They all seem dead on to me. What do you think?

1. Pets are becoming medically underserved

Credit: thegooddogcare.comData shows the pet population in the U.S. is climbing, but visits to veterinarians are declining. On an annual basis in 2007, dogs saw a veterinarian 2.6 times per year and cats only 1.7 times, indicating cats are affected more than dogs. This number has continued to decline in the aftermath of the Great Recession of 2008. Taking your cat or dog to the veterinarian allows early detection and intervention before medical problems like obesity cause serious disease.

2. Obesity in pets, like in humans, is skyrocketing

Veterinarians know pets are getting fatter, but research has shown pet owners are not likely to recognize obesity in their pets, perhaps because they themselves are overweight. In dogs, obesity is linked to an increased body mass index (BMI) in their owners. If you love your pet and want it to live a long, healthy life, keep its weight down. Obese pets have a shorter lifespan and increased risk of cancer, heart disease, respiratory problems, bladder disease, and, like humans, diabetes.

3. Diabetes is increasing in both cats and dogs

Banfield State of Pet Health reports a 32% increase in diabetes in dogs and 16% increase in cats, comparing 2006 to 2010. This is likely tied to the obesity epidemic in pets. Diabetes can be treated in dogs and cats, but it involves someone in the family injecting insulin once or twice daily under the skin and monitoring response to treatment. Preventing diabetes by maintaining an ideal body weight is simply easier for everyone.

4. Cancer: a major illness in both cats and dogs

According to the Morris Animal Foundation, 1 in 4 dogs dies from cancer and cancer is the leading cause of death in dogs over 2 years of age. In dogs, breed is strongly associated with specific types of cancer. Golden retrievers commonly develop lymphoma, German shepherds a splenic tumor called hemangiosarcoma, and Pugs a skin tumor known as a mast cell tumor. Cats get cancer too, most commonly lymphoma. Annual examinations and blood tests by your family veterinarian will help to detect tumors while they are still easily treatable.

5. Dental disease is on the rise

Reluctant is the descriptor for many pet owners when it comes to dental procedures in their pets. I understand their concern for the required general anesthesia, but I am concerned their reluctance is compromising their pet?s health. Periodontal disease is very prevalent in cats and in all cats had evidence of periodontal disease. Over 10% were severely affected and nearly all had bone loss in the jaw as determined by dental x-rays.

Having periodontal disease may cause collateral damage in other parts of your pet?s body. In dogs, periodontal disease was associated with increases in markers of systemic inflammation and indicators of failing kidney function, and was also associated with endocarditis and heart muscle problems.

Group hopes N. Korea concert spurs understanding

ATLANTA (AP) ? Humanitarians trying to organize an unprecedented U.S. visit by North Korea's national orchestra hope to strike a chord of reconciliation between the two enemy nations, but they still face plenty of hurdles before a single note is played on American soil.

Global Resource Services, an Atlanta-based humanitarian group, is working to bring the North Korean National Symphony Orchestra to the U.S. this spring for an 18-day visit that would kick off in Atlanta and end in a rousing finale in New York.

The group has brought 40 delegations from North Korea to the U.S. over the last 15 years but none have faced as many diplomatic, security or logistical roadblocks as this proposal. It involves flying 164 North Korean musicians, journalists and officials here for a series of concerts, training sessions and public appearances, all captured by a behind-the-scenes documentary.

The plans are far from complete. Organizers are still working to raise $3 million to pay for the trip and to get clearance from both governments for the journey. They also must secure visas from the U.S. State Department. Officials there declined to comment about the effort

Still, the nonprofit's leaders are optimistic the full orchestra could touch down in the U.S. this spring.

"We're still working on our plans," said Robert Springs, the group's president. "And we're trying to leave the door open and to work as closely as possible with authorities so we're ready when the time is right."

Springs has plenty of experience with navigating the challenges involving the two nations, which remain enemy states after a three-year war that ended in a truce in 1953. His group has sent three musical groups to North Korea, including the Christian rock group Casting Crowns. It is also preparing to send a 150-member Georgia-based chorus and orchestra to North Korea in a few weeks.

Springs first started working to bring the national orchestra to the U.S. in 2010. He was finalizing preparations for a February visit when it was put on hold after the death of North Korea leader Kim Jong Il in December. He said cultural exchanges are an important part of humanitarian work that also includes delivering food, digging new freshwater wells and training physicians.

"We committed to this project because we believe it could be a catalyst for change and a sustainable change to help lead us on a road to reconciliation," he said. "This could be the tipping point of that event."

He released a video on Thursday of interviews with several North Korean orchestra members who said they were excited by the prospect of sharing their music with Americans.

"This tour can be a wonderful opportunity to lead the emotions of our people and the Americans in several good directions that include peace, friendship, mutual understanding and respect," said Jang Ryong Sik, the orchestra's chief conductor, through a translator.

"What we would like to do if we go to the U.S. is to share with the American people our heart and soul, what we think and what we are proud of."

In his new book ?Finance and the Good Society,? Yale economist and best-selling author Robert Shiller argues that financial capitalism is the best system the world has ever known for democratizing wealth. He also concedes in the book, which will be published by Princeton University Press next month, that the system has serious flaws. Before Greg Smith blew the whistle on Goldman Sachs in the New York Times, Shiller had specifically addressed the issue of financial industry malfeasance in a chapter of his book titled, ?Some Unfortunate Incentives to Sleaziness Inherent in Finance.?

Weight Gain And Cholesterol | Health, Skin Care & Beauty

It's really not a secret that there is a connection between weight gain and cholesterol levels. If you are overweight one of the best things you can do for your body is lose your excess body weight.

Weight gain and cholesterol is a common problem for many people as they age. When we age we often have slower metabolisms and just don't get as much exercise.

Those factors can lead to an increase in the amount of excess body fat you put on.

Of course, sometimes having trouble with your cholesterol levels is a result of hereditary factors, but more often than not it is a result of lifestyle choices.

If we eat too many foods that are bad for us: high in fat and calories and generally lacking in any nutritional value, for example, we will most likely gain weight as well as increase the levels of bad cholesterol.

According to the American Heart Association, you should try to keep your overall cholesterol levels below 199mg/dl. Your bad cholesterol levels, LDL, should be less than 99mg/dl.

The higher your LDL levels the more fat you have in your bloodstream. This fat can clog your arteries and lead to many serious health related issues such as heart attack and stroke.

Of course, you do have many ways you can help control your cholesterol levels and you don't have to (in many cases, ultimately you need to ask your doctor) rely solely on medication.

Eating right is your first line of defense. For many people, just eating a healthier diet will be enough to prevent developing any cholesterol problems in the first place.

Lean protein, vegetables, more fruits and lots of water can go a long way to ensure that your cholesterol levels are kept where they should be.

You can start small too. Just stop eating so much of the bad stuff. If you really love your burgers why not just cut back on the amount you have in a week?

Or, why not try a leaner ground beef or possibly even a turkey burger. It's up to you but you can see that there are many simple things you can do to eat better and not eating as much bad stuff.

Another simple fix is to eat less sugar. For many people this can be accomplished just by cutting way back on some of the beverages they drink.

I had a friend who lost 10 lbs. in one month and the only thing she did was stop drinking pop. Most beverages are loaded with sugar and some of the worst offenders are energy drinks.

Getting less sugar in your diet can be a simple way for you to loss excess body fat and lose weight.

Weight gain and cholesterol do go hand in hand but you can lose weight with some simple changes to your diet and exercise program. Don't give up and make sure you talk to your doctor before you start, but you really can have a positive impact on your cholesterol levels.

Surprise: Protons bypass hydrogen bonds but still change molecules

ScienceDaily (Mar. 18, 2012) ? When a proton -- the bare nucleus of a hydrogen atom -- transfers from one molecule to another, or moves within a molecule, the result is a hydrogen bond, in which the proton and another atom like nitrogen or oxygen share electrons. Conventional wisdom has it that proton transfers can only happen using hydrogen bonds as conduits, "proton wires" of hydrogen-bonded networks that can connect and reconnect to alter molecular properties.

Hydrogen bonds are found everywhere in chemistry and biology and are critical in DNA and RNA, where they bond the base pairs that encode genes and map protein structures. Recently a team of researchers using the Advanced Light Source (ALS) at the U.S. Department of Energy's Lawrence Berkeley National Laboratory (Berkeley Lab) discovered to their surprise that in special cases protons can find ways to transfer even when hydrogen bonds are blocked. The team's results appear in Nature Chemistry.

A group led by Musahid Ahmed, a senior scientists in Berkeley Lab's Chemical Sciences Division (CSD), has long collaborated with a theoretical research group at the University of Southern California (USC) headed by Anna Krylov. In recent work to understand how bases are bonded in staircase-like molecules like DNA and RNA, Krylov's group made computer models of paired, ring-shaped uracil molecules, and investigated what might happen to these doubled forms (dimers) when they were subjected to ionization -- the removal of one or more electrons with resulting net positive charge.

Uracil is one of the four nucleobases of RNA, whose structure is similar to DNA except that, while both use the bases adenine, cytosine, and guanine, in DNA the fourth base is thymine and in RNA it's uracil. The USC group used a uracil dimer labeled 1,3-dimethyluracil -- "a strange creature that doesn't necessarily exist in nature," says CSD's Amir Golan, who led the Berkeley Lab team at the ALS. The purpose of this strange creature, Golan says, is to block hydrogen bonding of the two identical monomers of the uracil dimer by attaching a methyl group to each, "because methyl groups are poison to hydrogen bonds."

The uracils could still bond in the vertical direction by means of pi bonds, which are perpendicular to the usual plane of bonding among the flat rings of uracil and other nucleobases. "Pi stacking" is important in the configuration of DNA and RNA, in protein folding, and in other chemical structures as well, and pi stacking was what interested the USC researchers. They brought their theoretical calculations to Berkeley Lab for experimental testing at the ALS's Chemical Dynamics beamline 9.0.2.

To examine how the molecules were bonded, Golan and his colleagues first created a gaseous molecular beam of real methylated uracil monomers and dimers, then ionized them with a beam of energetic ultraviolet light from the ALS synchrotron. The resulting species were weighed in a mass spectrometer to see how the uracil had responded to the extra boost of energy.

"Uracils could be joined by hydrogen bonds or by pi bonds, but these uracils had been methylated to block hydrogen bonds. So what we expected to see when we ionized them was that if they were bonded, they would have to be stacked on top of each other," Golan says. Instead of holding together by pi bonds, however, when ionized some uracil dimers had fallen apart into monomers that carried an extra proton.

Where the protons come from

"What we did not expect to see was proton transfer," Golan says. "Surprising as this was, we needed to find where the protons were coming from. The methyl groups consist of a single carbon atom and three hydrogen atoms, but methylated uracil has other hydrogens too. Still, the methyl groups were the natural suspects."

To test this hypothesis, the researchers invited colleagues from Berkeley Lab's Molecular Foundry to join the collaboration. They created methyl groups in which the hydrogen atoms -- which like most hydrogen had single protons as their nuclei -- were replaced by deuterium atoms, "heavy hydrogen" atoms with nuclei consisting of a proton and a neutron of virtually the same mass.

The molecular beam experiment was repeated at the ALS, and once again some of the methylated uracil dimers fell apart into monomers upon ionization. This time, however, the tell-tale monomers were not simply protonated, they were deuterated.

Says Golan, "By looking at the mass of the fragments we could see that instead of uracil plus one" -- the mass of a single proton -- "they were uracil plus two" -- a proton and neutron, or deuteron. "This proved that indeed the transferred protons came from the methyl groups."

The experiment showed that proton transfer in this case followed a very different route from the usual process of hydrogen bonding. Here the transfer involved not just an attraction between molecular arrangements that were slightly positively charged and others that were slightly negatively charged, as in a hydrogen bond. Instead it required significant rearrangements of the two uracil dimer fragments, to allow protons of hydrogen atoms in the methyl group on one monomer to move closer to an oxygen atom in the other. Theoretical calculations of the new pathway were led by USC's Krylov and Ksenia Bravaya.

The moral of the story, says Golan, is that methyl groups do not always kill proton transfer. "Granted, this was a model system -- what we did was ionize the uracil systems in the gas phase instead of in solution, as would be the case in a living organism," he says. "Nevertheless, we showed that proton transfer is possible without hydrogen-bonding networks. Which means there could be unsuspected pathways for proton transfer in RNA and DNA and other biological processes -- especially those that involve pi-stacking -- as well as in environmental chemistry and in purely chemical processes like catalysis."

The next step: a range of new experiments to directly map proton transfer rates and gain structural insight into the transfer mechanism, with the goal of visualizing these unexpected new pathways for proton transfer.

Syracuse avoids being first No. 1 to lose to 16

(AP) ? The sighs were audible from the Syracuse fans. So were the complaints from those rooting for North Carolina-Asheville.

Another scare for a No. 1 seed against a lowly 16 was over. The Orange took the lead for good with about 6 minutes to go Thursday and then held on for a 72-65 victory in the second round of the East Regional.

The win made the No. 1s 109-0 since the field went to 64 teams in 1985. Nobody wants to be the team that starts that list. Least of all Syracuse, which was the first No. 2 seed to lose to a 15 when Richmond beat the Orange 73-69 in 1991.

The crowd of 18,927 at the Consol Energy Center ? except those wearing orange ? were cheering hard for the Bulldogs, the Big South Conference champions who were in the NCAA tournament for just the third time, all as a 16 seed.

"That always happens," Syracuse coach Jim Boeheim said. "If you're a high seed, the crowd gets going, the crowd is always going to switch to them. We lost one road game this year. We've been in some really noisy places when the crowd has not been with us. We've been in those games. We were in that game tonight. You know, it's not something that we haven't been able to handle, and we handled it tonight."

The Orange (32-2) were playing for the first time since starting center Fab Melo, the Big East Defensive Player of the Year, was ruled ineligible for the tournament over academics. Syracuse still had a size advantage without the 7-footer ? Asheville's tallest starter was 6-5 ? yet the Orange kept shooting 3-poiinters and kept missing. They missed 17 of their first 20 from beyond the arc and finished 5 of 23.

"We did not move the ball or attack the zone well," Boeheim said.

The Orange are famed for their 2-3 zone, a staple of the program for decades. Asheville (24-10) played the same thing Thursday and it worked.

"We just played a good 2-3 zone and mixed it up a little bit, playing man-to-man on one possession, zone on the other, just enough to try to keep 'em off balance," Bulldogs coach Eddie Biedenbach said.

But this game will be remembered for the final minutes when the officials made two calls that had the crowd booing and shouting.

The Bulldogs got within three points three times in the final 1:04 but could get no closer as Syracuse made its free throws and there were those calls.

The first call that caused the crowd to react was a lane violation with 1:20 left. Syracuse's Scoop Jardine missed the front end of a 1-and-1 but J.P. Primm was called for passing the head of the key before Jardine let the shot go. Jardine got to shoot the front end again, made it, and made the second for a 64-58 lead.

"They gave me a second chance to make the shot and I made it," Jardine said. "I got myself into a rhythm. I made every free throw from there on out because I do what I practice and believed in myself at that time and made the shots for us."

Primm said: "They showed it on the replay, I think the crowd let him know that it wasn't the right call. ... Like I said, when it gets crunch time like that, like I say, everyone is human."

With 35 seconds left and the Orange leading 66-63, the ball appeared to go out of bounds off Syracuse's Brandon Triche, but the officials pointed the other way and gave it to the Orange. Jardine made two free throws a second later.

"The out of bounds is not reviewable and it is not a play we would discuss," official Ed Corbett told a pool reporter. "I'm not going to comment further because it is a judgment call. It was a clear (lane) violation. The player released early, before the ball hit the rim. We've since watched the replay 20 times and it was the right call."

Boeheim had his own take on the play with Triche.

"First of all, all the noise about the ball going out of bounds, I mean, Triche got pushed. That's why it went out of bounds," he said. "Maybe they missed the out of bounds, they missed the foul call. Those things equal out."

Not for 16s against No. 1s.

"It's tough when things don't go your way," said Primm, who led the Bulldogs with 18 points. "In college basketball, sometimes you have to play everybody in the building, you know. But I feel like that at that point in time the crowd definitely got behind us. Because, you know, everyone loves to see a 16 beat a 1. It didn't happen tonight."

There was no talk of moral victories, not from a team that had talked Wednesday of making history.

"You know, we're not satisfied. We came in the game to win," Primm said. "Like I said, I personally felt like the better team didn't win tonight. That's my opinion."

Syracuse (32-2) will play eighth-seeded Kansas State in the third round on Saturday. The Wildcats (22-10) beat Southern Mississippi 70-64 behind Rodney McGruder's 30 points and the Jordan Henriquez's 15 points, nine rebounds and six blocks. Neil Watson led Southern Mississippi (25-9) with 16 points

In the other doubleheader, second-seeded Ohio State beat Loyola, Md. 78-59 and seventh-seeded Gonzaga defeated West Virginia 77-54.

Deshaun Thomas had a career-high 31 points for Ohio State (28-7), which dominated the Greyhounds inside, finishing with a 49-24 rebound advantage. Erik Etherly had 19 points for Loyola (24-9).

Gonzaga won its opening game in the tournament for the fourth straight year and it was the Bulldogs' second-largest margin of victory behind a 27-point win over Valparaiso in 2004. Robert Sacre and Gary Bell Jr. both had 14 points for Gonzaga (26-6). Kevin Jones had 13 points for the Mountaineers (19-14) in their worst NCAA loss under coach Bob Huggins.

Asheville led 34-30 at halftime but the Orange took the lead for good with 6:17 left on a turnaround jumper by reserve James Southerland, who had 15 points and a season-high eight rebounds.

Southerland, who scored 13 points in the second half, had three of the Orange's five 3-pointers.

"James came in, gave us a huge lift off the bench," Boeheim said of the 6-8 junior.

Kris Joseph and Dion Waiters both had 12 points for Syracuse, which played its fourth game this season without Melo, who missed three games in January over academic issues. The Orange are 3-1 without him.

"We (would) love to have him, but it's about us playing the game," Jardine said. "We got a lot of guys that stepped up today."

Jaron Lane added 16 points and Jeremy Atkinson had 12 for the Bulldogs, whose leading scorer, Matt Dickey, went 1 for 13 from the field, 1 of 9 from 3. Asheville went 9 of 23 from beyond the arc.

"The excitement of the game was crazy. It was March Madness at its finest," Dickey said. "It was awesome and we'll cherish this moment and the opportunity that we had, but we'll always look back at this moment and say we should have won or could have won, but that's not enough."

Boeheim earned his 46th win in the NCAA tournament, breaking a tie with Bob Knight for seventh on the career list.

Editors' Note: PCMag.com originally reviewed the PlayBook on 4/13/11 and rated it 2.5 stars. Almost one year later, we're testing the PlayBook again in light of its much lower list price and significantly revised PlayBook 2.0 Tablet OS.

Research In Motion's much-maligned tablet computer, the BlackBerry PlayBook, is finally a viable choice, thanks to its heavily revised OS and a massive price drop. The PlayBook's user interface is beautiful, graceful, and operates with a simplicity that rivals that of the Apple iPad 2 ($399 for 16GB, 4.5 stars) and bests current Android tablets like the Asus Eee Pad Transformer Prime ($499 for 32GB, 4 stars). The BlackBerry PlayBook is also much less expensive than before, at just $199 for 16GB, $249 for 32GB, and $299 for 64GB. In fact, the 16GB $199 model is the same price as the 8GB Amazon Kindle Fire ($199, 4 stars), although the Kindle Fire is a more capable media machine, with its nicely integrated, cloud-based ecosystem of books, music, and movies. Meanwhile, the PlayBook still suffers from a dearth of compelling apps. And Apple's third-generation iPad, which is just hitting stores, makes an argument for buying a PlayBook all that much tougher.

Design, User Interface, and Hardware
The BlackBerry PlayBook remains a nice piece of hardware. It measures 5.1 by 7.6 by 0.4 inches (HWD) and weighs 14.4 ounces. Its black glass front panel, and tapered, soft touch back panel are comfortable to hold. The 1,024-by-600-pixel display matches what you get with the Kindle Fire, though the PlayBook's is a bit brighter and more vibrant. There's no Home button; instead, you sweep up from the bezel to the center of the display with your finger. There's also a 6-axis internal gyroscope and accelerometer. On the PlayBook's top edge, you'll find a standard size 3.5mm headphone jack, plus hardware volume, playback, and power buttons. The bottom edge houses a micro HDMI output, a micro USB connector, and a magnetic charging port similar to the one on the Apple MacBook Pro. It works with RIM's optional dock accessory, but you only get a standard micro USB cable and charger in the box.

The PlayBook's user interface is quite polished; this tablet is pretty fun to use. The graphics and overall layout looks sharp and colorful, and it's easy to launch apps, see what's running in the background, and generally move around and get things done. The main menu is like a giant version of the one on recent BlackBerrys. A dock along the bottom of the screen holds five icons to start with, then expands upward to display many more icons.

A 4G version of the PlayBook never materialized, but the built-in Internet tethering feature is a nice bonus. If you own a BlackBerry phone, you can use its signal as a hotspot for the PlayBook via Bluetooth. There is no extra charge for this, so for BlackBerry owners, the Wi-Fi-only PlayBook is a better deal than it is for anyone else.

Having sufficient hardware power also helps; thankfully, the PlayBook does. The TI OMAP4430 CPU is a dual-core, 1GHz ARM Cortex-A9 chip, with a dual-channel memory controller and PowerVR SGX540 for graphics processing. You also get 802.11b/g/n Wi-Fi, including a file-sharing feature that lets you transfer files wirelessly from other computers on the same Wi-Fi network. We had good luck with Windows 7 machines, but ran into some difficulty transferring files from an iMac and a Windows XP system. Despite that, overall we saw far fewer bugs with the new OS than we did with the original version, which had spotty USB and wireless connectivity. Email, Browser, and Apps
The biggest news with the QNX-based PlayBook OS 2.0 is the inclusion of native email, contacts, and calendar support. It's only news in the sense that the PlayBook finally does what it should have done at launch last year. Native email is table stakes for any current mobile device, and the lack of it was frankly shocking. Regardless, I had no problem setting up email, contacts, and calendar using the native email app. The app works directly with Microsoft Exchange corporate servers. On the other hand, the PlayBook still can't sync with BlackBerry Enterprise Server, and it still doesn't run BlackBerry Messenger.

The Web browser remains a bright spot, with an intuitive interface, fast performance, and full Flash 10.1 support. Bookmarking, creating new tabs, and general navigation are all simple, and any page resizing problems the original OS had seem to be gone.

BlackBerry App World, RIM's answer to Apple's App Store and Google Play, contains roughly 10,000 apps made specifically for the PlayBook. Developers can also now submit Android apps to App World, which is supposed to speed up the store's growth. Unfortunately, that effort seems to be getting off to a rocky start.?I tried Pool Break Lite, which promptly froze the PlayBook and then crashed after about 30 seconds of black screen.

The glaring gap in functionality, selection, and overall quality between the PlayBook and other tablets is clear. For example, the big-name game title selection is spotty; you'll find Angry Birds, Monopoly, Dead Space, Madden, Plants vs. Zombies, and Need For Speed, but none of the other big franchises like NBA Jam, Dungeon Hunter, Infinity Blade, Real Racing, or even Scrabble or Words With Friends. There's no Netflix, Hulu, Kindle, Nook, Mint, Tumblr, Yelp Pandora, or Spotify. You can't run BlackBerry phone apps either, even in an expanded pixel mode. This is where the PlayBook still falls flat, even post-OS upgrade and post-massive price drop.

Multimedia, Camera, and Conclusions
The PlayBook isn't a bad companion for media consumption. Videos look vibrant, and the HDMI output lets you mirror the screen in 720p high-definition. The PlayBook supports H.264, MPEG4, XviD, and VC1 files. The Pictures app remains somewhat basic, but it displays images beautifully. Music playback is another strong suit, with an intuitive app layout and solid MP3, AAC, and WMA (but no FLAC) audio playback via the integrated stereo speakers. RIM's Music Store is affordable, has a decent selection, and lets you sample songs before purchasing them. The new BlackBerry Video Store offers a few thousand titles to choose from, and is nicely sorted by genre, with options to rent or buy movies.

The PlayBook has a pair of good cameras, though as with other tablets, only the front-facing one is useful. At 3 megapixels, it's actually pretty high resolution, and the new video chat app in OS 2.0 finally means you can do something with it. The PlayBook's rear-facing camera has a 5-megapixel sensor. It's not as good as the iPhone 4S but plenty capable, and much better than the terrible one on the iPad 2. It also records full 1080p high-definition video, just like the new iPad does, and you can output the results to an HDTV with the HDMI port. The battery lasted 8 hours and 15 minutes of continuous video playback with Wi-Fi on, which is very good as far as tablets go.

At $199 with its revised, polished operating system, the PlayBook is now a functional standalone device. If you're buying a small tablet for Web access and media playback rather than apps, the PlayBook is a good-looking alternative to the Editors' Choice Amazon Kindle Fire.

Just by the spec sheet and test results, this should be at least a 3.5-star product. But we're keeping it at three stars because we don't have faith in the ecosystem.?We're not convinced that the low sales of the PlayBook and lack of other QNX-based devices on the market will lead to more app development soon. Amazon offers not only a broader range of media, but a sense of the wind at its back and the ability to plug into the larger Android world. Even though this tablet has better specs, the Kindle Fire has more of a future, so the Kindle Fire remains our pick for small tablets.

Departing Goldman banker slams ''rip-off'' culture

LONDON/NEW YORK (Reuters) - Goldman Sachs faced an unprecedented assault from one of its own on Wednesday after a banker published a withering resignation letter in the New York Times, calling the Wall Street titan a "toxic" place where managing directors referred to their own clients as "muppets."

It was the latest blow for the investment bank. The company -- dubbed a "great vampire squid" in a 2009 article in Rolling Stone magazine -- has been embroiled in the biggest-ever insider trading scandal on Wall Street. And just weeks ago, a top judge criticized Goldman for big conflicts of interest in an energy deal.

In an opinion column in Wednesday's Times, Greg Smith, who worked in equity derivatives, said Goldman had become "as toxic and destructive as I have ever seen it.

"It makes me ill how callously people talk about ripping their clients off. Over the last 12 months I have seen five different managing directors refer to their own clients as 'muppets,'" Smith said.

In the United States "muppet" brings to mind lovable puppets like Kermit the Frog, but in Britain, "muppet" is slang for a stupid person. (Goldman, as it happens, was at one time also the bank for the family of Muppets creator Jim Henson.)

Goldman Sachs issued a short statement in response:

"We disagree with the views expressed, which we don't think reflect the way we run our business.?In our view, we will only be successful if our clients are successful.?This fundamental truth lies at the heart of how we conduct ourselves."

In a memo to staff, Goldman Chief Executive Lloyd Blankfein and Chief Operating Officer Gary Cohn said Smith's views were in the minority among his 12,000 fellow vice presidents.

"And, what do our people think about how we interact with our clients??Across the firm at all levels, 89 percent of you said that the firm provides exceptional service to them," they said in the memo, a copy of which was reviewed by Reuters.

Congressman Barney Frank, an architect of the 2010 Dodd-Frank financial reform law, said Smith's piece would have "a big impact" on the banking industry's efforts to push back against financial reform.

"It puts the burden on Goldman Sachs and others to show us how what they do benefits the clients and therefore the broader economy," he told Reuters.

Goldman shares closed 3.3 percent lower, on a day when broader markets were up slightly. At least one bank wasted no time in trying to take advantage of the situation.

"In my experience ... client success and firm success can peacefully coexist; in fact thrive," Harris Private Bank Chief Investment Officer Jack Ablin said in an open letter.

"Having served clients for nearly 30 years I can tell you that the long-term success of any institution, whether in the financial field or not, depends on the long-term success and satisfaction of its clients," said Ablin, who oversees $60 billion of investments for individuals and families.

But the company, which sometimes lacks for defenders, garnered at least some public support in response to Smith.

"The many people we have dealt with there have all been exceptionally talented and high-grade, and never once have we had a negative experience in which we felt that they took advantage of us or didn't do what they said they would do," well-known fund manager Whitney Tilson said in a note.

FRIENDLY AND GENUINE?

Smith, who did not return voice mails on his cellphone, carried the title of executive director, but it was not nearly as illustrious as it might sound. Goldman's roughly 12,000 vice presidents and executive directors compare with 450 managing directors -- the next rung up in the Goldman hierarchy and a job classification that Smith didn't achieve. Overall, the company has about 33,000 employees, meaning that 36 percent of Goldman's workforce carried a title similar to Smith's.

South African David Berman, founder of hedge fund Durban Capital and friends with Smith, called him "a very understated, humble type of guy who would tell the truth as truth is important to him.

"But he never struck me as the Goldman-type as he isn't aggressive nor (the) salesman type one expects," Berman said, adding, "I am convinced this is for real with no selfish intent here."

According to the British Financial Services Authority's register, Smith joined Goldman's UK unit a year ago.

Johannesburg-born Smith attended universities in his home country and in the United States, where he received a degree in economics from Stanford University in 2001. He also interviewed to be a Rhodes Scholar in South Africa in 2002.

While at student at Stanford he had a summer internship at Paine Webber in 1999 and a summer internship at Goldman in 2000. Upon graduating from Stanford in 2001, he landed at Goldman.

Internally, Smith's op-ed piece was not necessarily well received. A trader, who knew Smith in passing, said the company is telling staff that Smith is a disgruntled employee who is leaving because he didn't make managing director.

This trader, who did not want to be named, says former Goldman colleagues are saying that Smith "wasn't very commercial," which means he wasn't producing the kind of sales the company wanted.

PAST MEDIA STORMS

Goldman Sachs -- fourth among investment banks last year based on fee-income rankings compiled by Thomson Reuters and Freeman Consulting -- has a history of tension with client interests, experts say.

"Greg Smith refers to the last 12 years, but in fact Goldman has been doing this kind of thing since going back to the Great Depression," author William Cohan told Reuters Insider.

"It's not just the last 12 years; unfortunately it's part of the firm's DNA," said Cohan, author of the Goldman profile "Money and Power" and a former Wall Street banker himself.

In recent years the company has faced other high-profile incidents damaging to its image after the near-collapse of the global banking system in 2008.

Earlier this month it was accused of a major conflict of interest for advising El Paso Corp on its sale to Kinder Morgan, while being a significant shareholder in Kinder.

A lawyer representing an Australian fund in a lawsuit against Goldman over mortgage-backed securities, filed in New York last year and alleging fraud and breach of contract, said he may seek Smith's deposition to help bolster his case.

"Part of Goldman's defense is everybody is sophisticated and everybody knew as much as we knew did," the lawyer, Eric Lewis, said. "But if you're calling your clients muppets -- most muppets don't have the cranial capacity of Goldman."

Unsurprisingly, Smith's resignation letter captured the imagination of Twitter users. "Greg Smith" was a worldwide trending topic early Wednesday, meaning it had suddenly spiked in interest, while both that and "Goldman Sachs" were trending in the United States.

Many of the commentators expressed surprise about the allegations in the piece, while others called for Smith to shed light on why he left the bank, or pointed out that he seemed to have been employed in a comparatively junior role.

As happens on the Internet in cases like this, near-instant parodies of Smith's letter cropped up. The most popular by far had Darth Vader of "Star Wars" fame resigning from the Empire via a letter similar to Smith's.

"To put the problem in the simplest terms, throttling people with your mind continues to be sidelined in the way the firm operates and thinks about making people dead," the film franchise's dark lord wrote.

Coffee/Tea Drive Growth in Foodservice Industry; Sales Projected to ...

Coffee and tea remains a key foodservice industry growth driver, buoyed by aggressive menu innovation and a strong foothold in the breakfast daypart, according to ?Coffee and Tea Foodservice Trends in the U.S.,? a recently-released study from Packaged Facts.

Sales of coffee and tea at restaurant and drinking places are projected to reach $18.7 billion in 2012. Sales spiked 11% in 2011, driven by the return of consumers to the restaurant industry, aggressive coffee and tea menu innovation, increased penetration of coffee and tea among restaurant units, and menu price increases.

Some 173.5 million consumers drink tea and 183 million consumers drink coffee, according to David Sprinkle, publisher of Packaged Facts, eye-popping numbers that also imply limited usage growth potential. The challenge for foodservice operators, therefore, involves expanding varieties and occasions for use while converting home and office coffee and tea users into foodservice users.

?The Big Four? in this market?Dunkin Donuts, Green Mountain Coffee Roasters, McDonald?s, and Starbucks?each generate coffee and tea revenue in excess of $1 billion. Led by these mavericks, coffee and tea players continue to outperform restaurant industry growth, with restaurant brands across the foodservice spectrum pursuing incremental profits through improvements in coffee and tea quality and variety.

Data provided in the new study show that most leading coffeehouse/donut shop brands have grown same-store sales since 2005. Tim Hortons stands out, nonetheless, by not only posting a 21% cumulative increase in same-store sales, but weathering the recession with sales growth of 7% during 2008-2010 period.

While the percentage of restaurants that offer coffee rose across the board in the 2007-2011 period, especially notable is the increased presence of specialty coffee drinks such as cappuccinos, lattes, Americanos, and Macchiatos. Macchiato penetration has risen by over 50% since 2007, according to Datassential MenuTrends Direct data.

Correspondingly, the average price for coffee on the restaurant menu has risen 25% since 2007, with the highest increase at quick-service restaurants. In part, however, this price trend reflects operators passing on coffee commodity cost increases to consumers, as has also been the case at retail.

The rise in coffee prices has created significant challenges for industry players. Naturally, coffee commodity prices significantly affect coffeehouse expenditures, as well as those of restaurant operators with a significant coffee stake on the menu. But after rising to record levels in early 2011, coffee prices have begun to trend downward. Tea pricing stability may provide operators with higher margins than they receive for coffee, and, if history proves a barometer for the future, leave them less vulnerable to pricing volatility.

In addition, all regional and national coffeehouse chains now complement their beverages with food, and food platforms continue to expand. Against a competitive backdrop that includes quick-service restaurants offering quality food and beverages, coffeehouses need to supplement their beverages with a quality food selection or risk losing sales to players providing both, according to Packaged Facts.

Santorum spending primary day at home with family

Rick Santorum is spending early Tuesday with his family at their home near Washington as voters in Mississippi and Alabama weigh in on the Republican presidential field.

Santorum is set to fly later to Louisiana, which has its contest on March 24, for a rally in Lafayette that he hopes will turn into a celebration of a pair of victories in the deeply conservative states where he has spent much of the last week.

Santorum advisers are looking to best rival Newt Gingrich in his Southern stronghold and force him from the race so Santorum emerges as the chief opponent for campaign front-runner Mitt Romney.

"It's very, very clear where this race is heading," Santorum told supporters in Montgomery, Ala., before flying home to the Washington area.

"If the people of Alabama and Mississippi are willing to step up for us and say we want this to get to a two-person race, we want this to be a race where we have the opportunity _ not at convention but before a convention _ to nominate somebody who can stand up for the values that the people of Alabama believe in and vote for every day," he said.

Santorum trailed in delegate tallies heading into Tuesday. Romney is on pace to reach the 1,144 delegates needed to clinch the nomination in June. He has 454 delegates to Santorum's 217, according to an Associated Press count. Former House Speaker Newt Gingrich has 107 delegates and Texas Rep. Ron Paul has 47.

Santorum argues that the race is not yet over and the party must not nominate a Republican with Romney's record of policy shifts on issues such as abortion and gay rights.

"We already have a president who doesn't tell the truth," he said. "We don't need to nominate someone else who has that same problem."
